\nThe general conditions of sale described below detail the rights and obligations of the company
\nLRB RACING and of its customer within the framework of the sale of the goods of the mark MARSHAL and
\nLEGION.
\nAny service performed by the company LRB RACING therefore implies the buyer’s unreserved acceptance
\nof these general conditions of sale.<\/p>\n
\nThe prices of the goods sold are those in effect on the day the order is taken.\u00a0They are
\ndenominated in euros and calculated excluding taxes.\u00a0Consequently, they will be increased by the VAT rate and
\ntransport costs applicable on the day of the order.
\nLRB RACING grants itself the right to modify its prices at any time.\u00a0However, it
\nundertakes to invoice the goods ordered at the prices indicated when the
\norder is registered.<\/p>\n
\nThe prices offered include the discounts and rebates that the company LRB RACING would have to
\ngrant taking into account its results or the assumption by the purchaser of certain
\nservices.<\/p>\n
\nNo discount will be granted in the event of early payment.<\/p>\n
\nPayment for orders is made:<\/p>\n\n
\nIn the event of total or partial non-payment of the goods delivered on the day of receipt,
\nthe buyer must pay LRB RACING a late payment penalty equal to three times the
\ninterest rate.\u00a0legal.
\nThe rate of legal interest retained is that in force on the day of delivery of the goods.
\nThis penalty is calculated on the amount including VAT of the amount remaining due, and runs from the
\ndue date of the price without any prior formal notice being necessary.
\nIn addition to late payment compensation, any sum, including the deposit, not paid on its due date
\nwill automatically result in the payment of a lump sum compensation of 40 euros due for
\nrecovery.
\nArticles 441-6, I paragraph 12 and D. 441-5 of the Commercial Code.<\/p>\n
\nIf within fifteen days following the implementation of the \u201cLate payment\u201d clause, the buyer
\nhas not paid the sums remaining due, the sale will be automatically canceled and may open
\nright to the allocation of damages for the benefit of the company LRB RACING.<\/p>\n
\nLRB RACING retains ownership of the goods sold until full payment of the price, in
\nprincipal and accessories.\u00a0As such, if the buyer is the subject of a reorganization or a
\njudicial liquidation, the company LRB RACING reserves the right to claim, within the framework of the
\ncollective procedure, the goods sold and remained unpaid.<\/p>\n
\nis made:<\/p>\n\n
\nand is in no way guaranteed.
\nConsequently, any reasonable delay in the delivery of the products cannot give
\nrise to the benefit of the buyer:<\/p>\n\n
\nIn the event of goods missing or damaged during transport, the buyer must make
\nall the necessary reservations on the order form upon receipt of the said goods.\u00a0These
\nreservations must also be confirmed in writing within five days of delivery, by
\nregistered mail AR.<\/p>\n
\nThe responsibility of the company LRB RACING cannot be implemented if the non-execution or
\nthe delay in the execution of one of its obligations described in these general conditions
\nof sale results from a case of force majeure.\u00a0As such, force majeure means any
\nexternal, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.<\/p>\n
\nAny dispute relating to the interpretation and execution of these general conditions of sale is
\nsubject to French law.
\nFailing amicable resolution, the dispute will be brought before the Commercial Court of Aix en
